Definitions
In this document, the following words shall have the following meanings:
“Seller” means Caliponics.
“Terms and Conditions” means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.
“Buyer” means the person who buys Goods from the Seller. If a business or company accepts Goods from the Seller, the purchaser shall not be a Buyer as defined in these Terms and Conditions.
“Consumer” shall have the meaning ascribed in The Consumer Rights Act 2015.
“Goods” means the articles that the Buyer agrees to buy from the Seller.
“List Price” means the list of prices of the Goods maintained by the Seller as amended from time to time.
General
These Terms and Conditions apply to contracts for the sale of Goods by the Seller to the Buyer. They prevail over any other documentation or communication from the Buyer. The Buyer agrees to these Terms and Conditions when placing an order for Goods.
All orders for Goods by the Buyer are subject to these Terms and Conditions. The Seller may choose not to accept an order for any reason. Reasons that the Seller may refuse to supply Goods to the Buyer may include but are not limited to the following:
- Goods are out of stock or otherwise unavailable.
- The Seller cannot authorise your payment or any other problem with payment, such as suspected fraud.
- A pricing error.
- A product description error.
If the Seller refuses to supply Goods to the Buyer, the Seller will reimburse the Buyer any monies paid for those Goods and any delivery charge paid for the delivery of those Goods. The Seller will not be liable for any losses, costs, damage or expenses incurred by the Buyer if the Seller refuses to supply the Goods.
Acceptance of the goods’ delivery is conclusive proof of the Buyer’s acceptance of these Terms and Conditions.
Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Seller.
Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.
The Buyer must be at least 18 years of age.
The Buyer must provide the Seller with accurate information regarding the physical address for delivery, a current email address and telephone number for correspondence, and a valid form of payment. The Seller will not be liable for any losses, costs, damages or expenses arising from incorrect or inaccurate information supplied by the Buyer.
When making a payment, the Buyer must use a payment method that the Buyer is entitled to use. Any payment that the Seller suspects may involve a fraudulent payment may necessitate further investigation. These further investigations are to confirm that the Buyer has the right to use the payment method used. In this situation, the Goods will not be dispatched unless the Buyer can satisfy us that they have the right to use the method of payment used. This may require the Buyer to answer pertinent questions satisfactorily and provide adequate identification proof, including photo ID. The dispatch of the Goods to the Buyer will be delayed until the Seller is satisfied that the Buyer has the right to use the method of payment used.
If the Buyer uses PayPal as the payment method, then we can only ship to the address sent to us by PayPal. This address will be the one you nominate in your PayPal account or the address you enter when filling out your credit/debit card details.
Security
At Caliponics security is our number one priority and as such, we invest in the industries most advanced server monitoring and unbiased server reporting. Our dedicated web server is scanned daily by both Verisign and McAfee Secure for signs of any spyware, malware or server vulnerabilities. We also follow and successfully comply with PCI DSS.
The price of the Goods is the Seller’s current price on the Seller’s website at the date of order. The price is inclusive of VAT and exclusive of any delivery charges. The Seller reserves the right to amend any prices for any reason before dispatch. If the Seller amends the price after an order has been placed, the Seller will contact the Buyer, who will either proceed with the order or cancel it. In this event, the Seller will not be liable for any losses, costs, damages or expenses incurred by the Buyer.
Price and Payment
The Buyer must pay the total purchase price (including VAT and any delivery charges) in full, and funds must be cleared before the goods are dispatched.
Special offers and promotions are subject to availability and only apply during the quoted period.
All purchases on the website are in GBP (British Pounds).
All first time orders over the value of £500 will require photo ID to match the payment card name. This information is not stored and will be deleted as soon as the order has been processed. Without providing ID we will unfortunately need to cancel your order.
Shipping Policy
We have a flat shipping rate of £5.95 for all orders under £50.00. However, we offer free shipping for all orders over £50.00.
Our delivery time is 2 to 4 working days. Orders are usually processed within 1 to 2 working days, depending on the volume of orders.
Please note that we currently only ship to locations within the mainland United Kingdom.
Delivery
The Seller will only deliver Goods to the Buyer upon receipt of payment, and the Seller is satisfied that the Buyer has the right to use the method of payment used.
The Seller will notify the Buyer that Goods are available for collection at the destination provided at the time of order.
All Goods, wherever possible, will be delivered within 28 days of order. The Buyer will arrange to take receipt of the Goods when they are due for delivery. The Seller reserves the right to choose the delivery method. If the Buyer orders a bulky item or items, the Buyer should know that the order may arrive by pallet. In this circumstance, the Seller will make reasonable attempts to contact the Buyer and keep them informed of the situation and order progress.
If packaging or Goods are visibly damaged or compromised in any way, the receiver of the Goods must sign for the delivery as usual with the additional note: “received damaged”.
The Seller is not liable for any losses, costs, damages or expenses of any third party arising directly or indirectly from the damage or loss of the Goods during transit to the Buyer.
The Seller will endeavour to meet any date stated for delivery, though is not liable for any losses or expenses incurred by the Buyer or any third party arising directly or indirectly from any failure to meet any estimated delivery date.
If the Seller is unable to deliver Goods within the time specified in Clause 5.3. the Seller will contact the Buyer to advise of the situation. The Buyer shall be entitled to cancel the order and receive a full refund or agree to later delivery date.
The Buyer should make arrangements for their order to be received when it is to be delivered. Should the Buyer, or nominated party not receive the delivery of their order, then the courier may make one or two further attempts. After this, the order will be returned to the Seller. In this instance, the Seller will require an additional delivery charge to be paid before the Goods can be re-delivered. In this instance, the Buyer has the alternative option of cancelling their order and receiving a full refund of any monies paid less the cost of any failed deliveries.
Title and risk in the Goods shall pass to the Buyer upon delivery of the Goods.
The Seller is not to be held responsible for the safety of ordered goods against theft or damage in any circumstance in which the customer changes the delivery details after confirming their order or does not accept the goods in person. For example, customers changing the delivery point or requesting goods to be left with a neighbour. Caliponics would advise you to take the delivery in person at all times to ensure the safe carriage of your goods.
As per DPD terms and conditions, by selecting Authorised Shipment release, you authorise DPD to release packages addressed to you at your address when no one is present to receive the delivery. You will be asked and are required to accept responsibility for any loss or damage to the package after it has been released at the address.
Please note that our surcharge pricing covers 99% of orders, but should your order cost us considerably more to ship, we’ll contact you via email or telephone to take the rest of the payment.
Warranty
While the Seller makes every effort to ensure that prices, pictures, descriptions and specifications on this website are correct, all information is solely to give an approximate description of the Goods. Should the Goods that the Buyer receives be different to those described on the website, the Seller will accept the Goods back as long as they are in pristine condition and with all packaging intact, within a reasonable period. In this event, the Seller will refund the monies paid for the Goods, including any delivery charges. The Seller will not be liable for any losses, costs, damages or expenses arising from the Goods differing from the pictures, descriptions or specifications described on this website.
The Seller cannot be held responsible for cosmetic changes to the product packaging or labelling where the product remains the same specification.
The Buyer shall inspect the Goods immediately upon receipt and notify the Seller within five days of delivery if the Goods are damaged, incorrect, or do not comply with any part or parts of the contract.
Cancellations and Returns
Where the Buyer claims defective, incorrect, or damaged Goods, it shall be the Seller’s responsibility to collect the faulty Goods if the items are large. Otherwise, the Buyer should return the goods to the Seller. The Buyer shall be entitled to replacement Goods or a full refund (including delivery costs, if applicable) plus any return postal charges if the Seller confirms the Goods to be defective, incorrect or damaged at the point of delivery. The maximum value of return postal charges that we will refund is £15. The Seller may require the Buyer to provide photographic evidence of any defective, damaged or incorrect goods before their return. Goods to be returned must clearly show the order number obtained from the Seller on the package.
Where returned Goods are found to be damaged due to the Buyer’s fault, then the Buyer will be liable for the cost of remedying such damage.
Where Goods are purchased via the internet, mail order or phone, the Buyer has the right, in addition to any other rights, to cancel the Goods and receive a refund by informing the Seller in writing or by email within seven working days of receipt of the Goods. Returned goods must be in resalable condition in complete and undamaged packaging with all seals intact. Goods that have been opened or used will be deemed accepted by the customer, and no refund or exchange can be given.
Where the Buyer wishes to return Goods, the cost of the return, including postage and packing costs, will be at the Buyer’s expense and should be adequately insured during the return journey. When the Seller receives the Goods and deems the Goods to be in resalable condition, the Buyer shall receive a refund of all monies paid for the Goods, excluding delivery charges, if any.
When purchasing any of our kits, please note that you cannot get a part refund on specific items within the kit. The kit is treated as one item as we combine everything and work out prices based on all items within that kit. If you’re not happy with part of the kit and want a refund, you’ll need to refund the kit in its entirety.
When purchasing a kit that may have a faulty item, only that part would be refunded, replaced, or store credit provided if the supplier/manufacturer confirms a part is faulty. Any items from the kit not deemed faulty will be returned to the Buyer, and charges may apply.
If all parts of a kit have been deemed not faulty, they will be returned to the Buyer, and charges applied.
Any item considered faulty four weeks from the purchase must be sent to the original equipment supplier for testing under warranty for them to deem faulty or not.
Guarantees
In addition to the Buyer’s statutory rights, the Seller guarantees most Goods against faulty workmanship and materials for a period of 60 days from the date of delivery. Certain products such as High-Intensity Discharge lamps and fluorescent lamps may only be returned as faulty within 30 days of receipt.
You should keep all receipts and warranty information supplied with your order and goods. You have the right to return a faulty item within the period indicated in Clause 8.1. Faulty items must be returned in their original undamaged packaging with all the items that came with it, including instructions and any spare parts included as part of the product. With many products, the speediest resolution may be to contact the manufacturer directly for advice and rectification.
Limitation of Liability
The Seller shall not be liable for any direct loss or damage suffered by the Buyer howsoever caused, as a result of any misuse of the Goods, negligence, breach of contract or otherwise above the price of the Goods.
The Seller shall not be liable under any circumstances to the Buyer or any third party for any indirect or consequential loss of profit caused due to any misuse of the Goods, negligence, breach of contract, misrepresentation, or otherwise.
Force Majeure
Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control. Occurrences may include but are not limited to acts of God, strikes, lockouts, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply. The party shall be entitled to a reasonable extension of its obligations.
Severance
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.
Governing Law and Jurisdiction
Any disputes or claims regarding sales or services offered through the Caliponics website will be governed by English law. Any dispute or claim arising will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Eligibility
The competition is open to residents of the United Kingdom aged 18 years or over, excluding employees of Caliponics and their close relatives and anyone otherwise connected with the organisation of the competition.
Entry Method
Entry to the competition is obtained by subscribing to the Caliponics newsletter via www.caliponics.co.uk/ebay-support. No purchase is necessary to enter the competition.
Competition Period
The competition starts on 03/10/2023 and closes on 27/11/2023. Entries received after the closing date will not be considered.
Prize
The prize is a £100 Amazon Voucher. The prize is non-exchangeable, non-transferable, and no cash alternative is offered.
Winner Selection
The winner will be chosen at random from all valid entries received during the competition period.
Winner Notification
The winner will be notified by email within 7 days of the closing date. If the winner does not claim the prize within 14 days of notification, we reserve the right to withdraw the prize and pick a replacement winner.
Data Protection
Any personal data relating to participants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
Liability
Caliponics is not responsible for any damage, loss, injury, or disappointment suffered by any entrants as a result of accepting the prize.
Changes and Cancellation
Caliponics reserves the right to cancel the competition or amend these terms and conditions without prior notice at any time, for whatever reason.
Governing Law
The competition and these terms and conditions will be governed by English law, and any disputes will be subject to the exclusive jurisdiction of the courts of England.
